Terms of Service

1. Agreement to Terms

By creating an account or using Kolosseum ("the Service"), operated by Kolosseum ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By using Kolosseum you represent that you meet this requirement and that all information you provide is accurate.

3. Marketplace Role

Kolosseum is a peer-to-peer marketplace that connects buyers and sellers of luxury, designer, vintage, and streetwear goods. Kolosseum is not a party to transactions between users. We do not own, sell, authenticate, inspect, or ship the items listed on the Service. Each user is solely responsible for their listings, communications, payments, shipments, and disputes.

4. User Content & Listings

You retain ownership of the photos, descriptions, and other content you post ("User Content"). You grant Kolosseum a worldwide, non-exclusive, royalty-free license to host, display, and distribute your User Content for the purpose of operating and promoting the Service.

You agree not to post content that is: counterfeit, stolen, illegal, fraudulent, misleading, infringes intellectual property rights, or violates any applicable law. We reserve the right to remove any listing or content at our discretion.

5. Prohibited Conduct

You agree not to:

  • Sell counterfeit, replica, or unauthorized goods
  • Use the Service for money laundering, fraud, or any illegal purpose
  • Harass, threaten, or harm other users
  • Circumvent the Service to avoid fees or contact users off-platform to defraud them
  • Scrape, reverse-engineer, or interfere with the Service's technical operation
  • Create multiple accounts to evade bans or manipulate listings

6. Subscriptions & Payments

Some features of Kolosseum are available via paid subscription. Payments are processed by Stripe, Inc. By subscribing you authorize us (via Stripe) to charge your selected payment method on a recurring basis at the stated price until you cancel. You can cancel at any time from your account settings; cancellations take effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

7. Authentication & Safety

Kolosseum provides optional third-party authentication resources and safe-meetup location recommendations for your convenience. These resources are provided "as-is" and Kolosseum does not guarantee their accuracy, availability, or results. Use your own judgment when meeting other users in person.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. KOLOSSEUM DOES NOT WARRANT THAT LISTINGS ARE AUTHENTIC, ACCURATE, LEGAL, OR SAFE. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOLOSSEUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IN ANY MATTER WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100 USD.

10. Indemnification

You agree to indemnify and hold harmless Kolosseum and its affiliates from any claims, losses, or expenses arising from your User Content, your transactions with other users, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be announced through the Service. Your continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in California.
